CIVIL AND CRIMINAL LAW

Civil law regulates disputes between citizens within the country. There are disagreements between people or companies, between persons and their property and reputation, disagreements after people’s death, family problems. Criminal law regulates relations between citizens and the state. A crime is a wrong act which the state punishes.

Criminal and civil procedures are different. In criminal law the state starts a criminal action. In civil law an individual starts a civil action. The party that starts a criminal action is the prosecution. The party that starts a civil action is the plaintiff. The other party in both cases is the defendant.

CIVIL AND CRIMINAL LAW ( continued)

 

In many law systems it is important that a person is not guilty of a crime until the state proves that he is guilty. The person doesn’t need to prove anything. He can show evidence of his innocence.

Most criminal laws do with acts of violence or theft. But there are laws which regulate all possible situations: what we do with our land, for example; what we say and write; how we run our business, etc.

There are some acts which are crimes in one country but aren’t in another. For example, it is a crime to drink alcohol in Saudi Arabia, but not in Egypt. It is a crime to smoke marijuana in England, but not in the Netherlands. It is a crime to have more than one wife in France, but not in Indonesia.

It looks strange but in criminal law you can see punishment for an attempt of a coup d’etat but you cannot find any punishment for the coup d’etat itself.

… if a bedouin young man likes a girl he asks the elder of the tribe to arrange a meeting with the girl in the elder’s tent. During the meeting the girl offers the young man a cup of tea. If she puts sugar in the tea, it means that the girl likes the young man, too, if not – he has no chance.

Mrs. Brown is a teacher of an American school. She enjoys teaching her pupils because they usually think about everything carefully. One day she says to her children: “People in many countries of Asia wear white clothes at funerals but people in America and in Europe wear white clothes when they are happy. What colour does a woman wear in this country when she gets married, Alice?”

Alice says, “She wears white because she is happy.”

“That’s good, Alice,” Mrs. Brown says. “You are right.”

But then one of the boys in the class puts his hand up.

“Yes, John?” Mrs. Brown says. “Do you want to ask a question?”

“Yes, please.” John says. “Why do men wear black in this country when they get married?”
